Terms are likely to change upon opening in 2026 - core points will stay the same.• Terms apply to any receiver of my art - commissioned, traded or gifted •
^{If the art wasn't made for you, you may not use it.}• Artist retains copyright / ownership to all created art and may repost as desired •
^{Includes but not limiting to final artwork, work in progress images, recordings, streams, etc.}• Receiver retains copyright of their characters, designs and lore •• The artist agrees not to sell prints or merch of commissioned/traded/gifted art without prior client approval •• The artist does not use AI and will not work with clients that use generative AI •

🖼️ CLIENT / RECEIVER USAGE RIGHTS

✓ Repost the art whole and unedited online.✓ Use the art cropped for avatars / banners with written credit to ShiverCritter.✓ Use the art offline for their devices or as printed media for personal use.
^{Prints, Posters, Keychains, Notebooks, etc.}- - -✕ Do not edit the art or signature. (Cropping for avatars/banners is okay with credit)✕ Do not trace, recolor, heavily reference or claim you made the art.✕ Do not profit from the art or use the art commercially.✕ Do not post, use or share in-progress(WIP) sketches.✕ Do not involve the art in AI, Crypto, NFTs or similar.

💲 PAYMENTS

• Prices and Payments are in USD. Client is responsible for covering any differences or fees relating to currency conversion.• Commissions are paid via Paypal invoice.• Payment is required upfront regardless of the total. Friends or repeat clients may inquire about payment plans.
^{Payment plans must come with a firm deadline. Missing deadlines will result in cancellation and refund.}

❌ REFUNDS AND CANCELLATIONS

• Refunds are handled on a case-by-case basis and MUST be discussed with the artist first.• Refunds will not be issued for any reason once the final artwork is approved by the client.• Issuing a refund revokes any and all rights the client has to the artwork being made and the YCH will go back up for sale.• Chargeback attempts will result in cancellation, blacklisting from future sales and loss of right to the artwork.• The artist reserves the right to cancel and give a full refund if the work cannot be completed .

🔜 ART DELIVERY

• Art will be delivered digitally only - no prints or physical items are shipped.
^{WIPs will be sent via communication chat of choice (telegram or discord) - final and full resolution images will be sent via e-mail.}• The Artist is not required to store or host the art indefinitely.
^{I try to keep copies of every commission but I cannot guarantee indefinite storage. I am also not responsible for hosting them indefinitely in my galleries.}• If the client loses their art file, the artist is not responsible for replacing, refunding or otherwise compensating the client.

🔞 NSFW - Not Safe for Work - Gore, Kink and Fetish

• NSFW orders must be clearly stated as such from the beginning.
^{This includes 'technically safe for work' kink and fetishes such as clothed characters, bondage, vore and paws.}• NSFW will not and cannot be drawn for minors.• All characters depicted must be and appear to be adults.• Violent, Gore, Kink and Fetish Art of mine must be appropriately tagged and hidden from minors when reposted.
