• Terms apply to any receiver of my art - commissioned, traded, gifted or otherwise. •
If the art wasn't made for you, you may not use it.• Commissions are created with intent to be posted/viewed online.
Most of my canvases are 5x5 inch or bigger at 300 dpi but not always.
If you require something to be print quality or a specific size I must be told in advance.• All Commissions are personal-use by default.
Commercial-use commissions must be discussed before payment and are subject to increased prices and unique Terms of Service.

📝 GENERAL TERMS

• Client/Receiver must be 18 years old or older, I prefer not to work for minors.• The artist does not use generative AI and refuses to work with clients that use generative AI.• Artist retains copyright/ownership to all created art and may repost as desired.
Includes but not limiting to final artwork, work in progress images, recordings, streams, etc.
Unused WIPs and Concepts may be repurposed by the artist and are not included in the commission sale.• Receiver/Client retains copyright/ownership of their characters, designs and lore.• All Commissions are personal-use by default.
Commercial-use commissions must be discussed before payment and are subject to increased prices and unique Terms of Service.• An unobtrusive watermark is present in all personal-use commissions.• Private commissions must be discussed before ordering and are subject to a higher price.
These commissions may not be posted by either the artist or the commissioner and are intended to be enjoyed offline.

🖼️ USAGE RIGHTS

CLIENT / RECEIVER CAN :✓ Use the finished artwork for personal use - online and offline.
Decor, roleplays, avatars, banners, personal prints, stickers; etc.
Cropping for avatars/banners is okay with credit. Resizing is fine as long as the art remains whole.✓ Repost the art whole and unedited..
CLIENT / RECEIVER CANNOT :
✕ Do not profit from the art or use the art commercially.✕ Do not edit, trace, heavily reference or claim you made the art.✕ Do not post, use or share in-progress(WIP) sketches.✕ Do not involve the art in AI, Crypto, NFTs or similar.- - - - - - - - - - - - - - - - - - - - -

ARTIST CAN :✓ Repost the Artwork, WIPs, Timelapses and Stream Recordings to galleries, websites, portfolio examples, etc.✓ Repost the artwork, WIPs, Timelapses and Stream Recordings to sites like Ko-fi and Patreon for a paid audience.✓ Repurpose any unused WIPs for other artworks..
ARTIST CANNOT :
✕ Utilize or Re-Sell the finished art for commercial purposes such as prints or keychains.
(Art MAY be used as commission examples but may not be sold as a product.)✕ Turn the finished art into a YCH.
(Except in cases where the client was refunded.)✕ Directly re-use elements of the art such as the whole background or pose.
(Photo elements used in Backgrounds are not unique to the piece but are edited to look different piece to piece.)✕ Involve the art in AI, Crypto, NFTs or similar.

💲 PAYMENT

• Payments are handled through Artistree.• If the payment is NOT handled through Artistree, payment must be made in full at time of ordering.

✏️ Process, WIPs and Revisions

WIPs or 'Work in Progress' images are watermarked and not allowed to be shared by the client. Unused WIPs or concepts may be repurposed by the artist for other projects.• Errors made because the artist was given out of date or otherwise incorrect references are not required to be fixed.
• Character details and anatomy will be drawn as they are shown on the reference unless otherwise specified at time of ordering.⚠️ Reminder that clients are not allowed to use or share WIPs, WIPs will be watermarked.Process + Revision Steps
Sketch Phase - The rough sketches showing the basic pose and potential lighting layout. The artist will supply a few options for the client to pick from.
• 1-2 Major revisions are allowed here such as pose changes.Flat Color Phase - The lineart is done and flat colors are laid out.
• 1-2 Moderate revisions are allowed here such as changing the colors, mood lighting or time of day. Minor lineart edits may be requested but no redraws or pose changes.Final Approval - The illustration is complete.
• 1-3 Minor revisions can be made - such as fixing an error or adjusting something small.Edits or Revisions may no longer be requested after approval of the final art.⚠️ Revisions exceeding the amount above - or that impede the completion time of the order may incur extra fees for the extra work.

✏️ Skip the WIPs - take 10% off your order.

The Client can optionally select 'skip the WIPs' when ordering, giving the artist full creative liberty over the commission to choose the details, etc. The artist works best this way, and will try their best to bring the client's idea to life.This skips all the WIP stages and does NOT offer the rough concepts to choose from, major or moderate revisions or edits.The only WIP the Client will get is final approval where they can request a couple minor revisions such as eye color or other very minor alterations.⚠️ This option offers NO refunds and cannot be changed after payment.

❌ REFUNDS AND CANCELLATIONS

• Refunds are handled on a case-by-case basis and MUST be discussed with the artist first.• The artist reserves the right to cancel any in-progress order with a full refund.• Issuing a refund revokes any and all rights the client has to the artwork being made.
- Client characters will be removed and the art and/or WIPs may be repurposed and/or resold.• Refunds may not be requested or given after the final work is complete and delivered.• Chargeback attempts will result in cancellation, blacklisting from future sales and loss of right to use the artwork.

🔜 ART DELIVERY

• Art will be delivered digitally as a PNG if it's a still illustration or GIF file if it's an animation - no prints or physical items are shipped.• The Artist does not deliver PSDs or layer files unless the commission is a color-in base or similar, requiring a PSD to be delivered.• The Artist is not required to store or host the art indefinitely.
I try to keep copies of every commission but I cannot guarantee indefinite storage. I am also not responsible for hosting them indefinitely in my galleries.• If the client loses their art file, the artist is not responsible for replacing, refunding or otherwise compensating the client.

💲 COMMERCIAL USE

Commercial use must be discussed with the artist in advance before payment is made.Any commission made for the intent of profit or promotion for the client.
This includes, but is not limited to - serial or reoccurring comics of their series which is intended to be posted or published, promotional material, art for games, concept art, book covers or story illustrations, color-in bases for adoptables or design sales, merchandise designs like stickers, keychains and the like.• Commercial Use Commissions come watermark-free and may be kept private under NDA.• Commercial Use Commissions are subject to a unique Terms of Service contract and new pricing unique to each arrangement.

• NSFW orders must be clearly stated as such from the beginning.
This includes 'technically safe for work' kinks, fetishes and violence.• NSFW will not and cannot be drawn for minors.• All characters depicted must be and appear to be adults.• Violent, Gore, Kink and Fetish Art must be appropriately tagged and hidden from minors when reposted.
